In public procurements, tenderers must fulfil the mandatory requirements. We have considerable experience of reviewing clients’ tenders in public procurements in order to reduce the risk of a tender being rejected.
In addition, our advice to suppliers includes, among other things, reviewing and interpreting requirements, formulating questions to the purchaser in Q&As in the procurement, interpretation of contract terms and conditions as well as advice in conjunction with negotiations and other contacts between the supplier and the purchaser.
We have experience of advising contracting authorities and entities in extensive and complex public procurements, especially with a focus on IT and other procurements of technically complex goods and services. We assemble a dedicated team for the client in which our procurement law experts work together with Vinge’s specialists in commercial agreements within IT, telecommunications and outsourcing and, where necessary, by using specialist competence from other relevant practices areas, (for example, employment law, competition law and intellectual property law).
In addition, we are the only Swedish business law firm which also has its own in-house team of experienced economists who provide advice to clients from a financial and mathematical perspective, e.g., in conjunction with reviews of evaluation model in procurements. Vinge regularly advises suppliers and contracting authorities and entities in review proceedings relating to public procurements in the administrative courts. The regulatory procedural framework governing these types of proceedings is unique and requires specialist competence. The members of our team possess extensive experience of conducting litigation in all court instances and one member of the team is a former justice in the Swedish Supreme Administrative Court. Our unique experience and expertise in relation to court proceedings in the field of public procurement enables us to manage the largest and most complex review proceedings. In addition, our significant litigation experience also means that, in the context of day-to-day legal advice, we can thus clearly focus on practically relevant risks and possibilities in connection with public procurements.
We also provide tort litigation advice to clients in proceedings before the general courts where public procurement law issues are raised and, from our Brussels office, before the Court of Justice of the European Union regarding issues related to both procurement as well as other legal matters pertaining to EU law.
We provide legal advice to clients in conjunction with all issues regarding public procurements. Our advice relates to all types of contracts and concessions which fall within the scope of the public procurement legislation. This includes the formulation or review of procurement documentation and different decisions taken during course of the procurement, drafting or reviewing agreements. We also provide advice to clients concerning issues in relation to public documents and confidentiality, as well as the protective security legislation in connection with public procurements. Public procurement is also relevant within other practice areas such as M&A.
